REACTIVEPAY TECH DOO CORPORATE ACCOUNT TERMS AND CONDITIONS

This document sets out the terms and conditions for your ReactivePay Tech DOO business account (the “Account”) and its related services. It also sets out other important things that you need to know. These terms and conditions (“these Terms”), along with our Fees, form a legal agreement (the “Agreement”) between you, the Account holder; and us, ReactivePay Tech DOO. By pressing the I Accept the Agreement you confirm that you have read, understood, and accepted it.

  1. Introduction to ReactivePay Tech DOO

    • ReactivePay Tech DOO is authorised by Official Gazete of the Republic of Serbia, Nos. 99/2011, 83/2014 and 31/2019) (registration number: 21774731)
    • Any references to “Company”, “customer”, “I”, “me”, “my”, “you” or “your” in this Terms and Conditions, mean the legal entity in whose name the service is provided and who is agreeing to the Agreement.

  2. Information on these Terms
    We have drafted these Terms in a question-and-answer format so that they are easy to read and understand. However, if you have any queries at all, please do not hesitate to get in touch via email at sales@reactivepay.comTo meet our legal and regulatory requirements we, or someone acting for us, might sometimes need to ask for more information . Please, provide this information quickly so that there is no disruption to our services.
  3. Keeping your security details safe
    We ask you and all authorized persons to do all you reasonably can to keep your (and their) security details safe. Security details include usernames and any personal data that you are leaving in the registration blank.

  1. How to make a complaint?
    If you feel that we have not met your expectations in the delivery of our services or if you have any other form of complaint, please let us know. You may inform us by email using the contact details.We will try to resolve any complaints you have about or the service we provide to you within 15 business days of receiving your complaint and in exceptional circumstances, within 35 business days (and we will let you know if this is the case).
  2. How can these Terms be terminated?
    You can terminate these Terms at any time by emailing us at sales@reactivepay.com
    We can terminate these Terms at any time by providing you with 2 months’ notice via email.
  3. When you might be responsible for our losses
    If you have broken these Terms, and this has caused us to suffer a loss, the following will apply:

    • you will be responsible for any losses we suffer as a result of your action (we will try to keep the losses to a minimum);
    • if your actions result in us losing profits, you may also be responsible for those losses. You won’t be responsible if this would mean that we are compensated twice for the same loss;
    • you will be responsible for any reasonable legal costs that arise as a result of our losses.
  4. Permission for us to process your personal information
    To provide services under the Agreement we may need to collect information about you (and any authorized person). In certain circumstances that information may constitute ‘personal data’ for the purposes of the Data Protection Act. Under data protection law, we are what is known as the ‘data controller’ of your personal information. By entering into the Agreement you are giving us permission (and the permission of any authorized person) to gather, store and process personal information for the purpose of providing our services to you. This doesn’t affect any rights and obligations you or we have under data protection law.
  5. Our intellectual property
    We own all the intellectual property in our products (for example, the content at the https://reactivepay.com, and our logo and card designs). You must not use our intellectual property as your own, except to enjoy our products. You also must not reverse-engineer any of our products (that is, reproduce them after a detailed examination of their construction or composition).
  6. Which laws govern these Terms?
    These Terms and any contract to which these Terms apply and any disputes or claims arising out of or in connection with these Terms or any such contract or its or their subject matter or formation (including non-contractual disputes or claims) are governed by, and construed in accordance with, the laws of Serbia.
  7. Where can I bring legal proceedings in relation to these Terms?
    You might prefer to exhaust our complaints procedures before taking legal proceedings in court. However, if you wish to take legal proceedings in court, you can bring proceedings in the courts of Serbia.
  8. Who can make changes to these Terms?
    You are unable to make changes to these Terms. If we add a new product or service that doesn’t change the existing terms and conditions, we may add the product or service immediately and let you know the applicable terms before you use it. Otherwise, we may amend these Terms by giving you no less than 2 months’ notice in writing. If you object to the proposed amendments, you have the right to terminate these Terms before the date proposed by us for the entry into force of the changes. You will be deemed to have accepted the proposed amendments unless you notify us and terminate these Terms before the date proposed by us for the entry into force of the changes. If we receive no objection from you, such amendments shall take effect from the date specified by us but may not affect any rights or obligations that have already arisen and will not be retrospective. If we change these Terms, the updated terms will be available on the https://reactivepay.com from the date the change takes place.
  9. Can this Agreement and associated contracts be transferred to another person?
    Yes, we may transfer our rights and obligations under these Terms and any associated contract to another organisation without your consent. We will always tell you in writing if this happens and will ensure that the transfer will not affect your rights under these Terms or any associated contract. You may only transfer your rights or your obligations under these Terms or any associated contract to another person if we agree to this in writing.
  10. Can a third party enforce any right in this Agreement?
    No, this Agreement does not give rise to any rights under the Contracts to enforce any
    term of this Agreement.
  11. Can I obtain a copy of these Terms?
    A copy of these Terms will always be available on the ReactivePay Website, and by contacting us using the contact details .
